With these limitations as stated on the record, the court denies the Motions to Quash and the Motions for Sanctions. With respect to the California Appraisal documents the subpoena must be limited to the partial that is the subject of the development in question about which plaintiff seeks damages in their complaint. With that limitation and with all documents obtained by subpoena being in subject to a stipulated protective order prepared by the parties and to be signed by the court that is for use for purposes of this litigation only and not disclosed to other parties. That motion to quash is denied. With respect to the subpoena to Scotts Valley Bank, the subpoena is limited to the application to the extent that it makes representations regarding leases that have been executed in connection with the development. Documents, notes, statements in Scotts Valley Banking in connection to this application that reflect representations of the plaintiffs regarding the leasing of the space and any documents, notations information contained in the Bank's file indicating their own determination of whether those representations were accurate. With that Subpoena the documents produced pursuant to that Subpoena to be also the subject of the same protective order. The motion for Sanctions are denied. The court will issue a brief summary order that states for the reasons set forth on the record that the hearing for Motions to Quash and for Sanctions are denied as with the subpoenas approved as limited on the record.
