August 5, 2010 Opinion or Order TEXT ORDER: Plaintiff's Motion Pursuant to Rule 59 to Vacate "Judgment" and Motion to Recuse District Judge Because of Irreparable Bias Against Plaintiff (d/e 18) (Motion) is DENIED. The Court sees no evidence of bias. Martin asks the Court to vacate the Judgment because the removal of the case to this Court was not proper. Martin claims that not all Defendants consented to the removal. Motions to remand for such defects, however, must be filed within 30 days of the filing of the notice of removal. 28 U.S.C. § 1447(c). The failure to object to removal in a timely matter constitutes a waiver of the issue. Johnson v. Burken, 930 F.2d 1202, 1206 (7th Cir. 1991). Here, the Notice of Removal was filed on November 10, 2009. Notice of Removal (d/e 1). Martin raised the issue for the first time in this Motion. The issue is waived. The Motion is DENIED.
