IT IS HEREBY ORDERED 36 Motion to Set Aside Default Judgment
DENIED. Defendants have not shown good cause as required by FRCP 55(c) and 60(b).
IT IS FURTHER ORDERED the stay as to [39], regarding the Judgment Debtor Examination of Calvin Ayre, and as to 35 Motion for Permanent Injunction, is lifted.
IT IS FURTHER ORDERED 35 Motion for Permanent Injunction is
DENIED. The Court finds Plaintiff failed to satisfy the requirements for permanent injunctive relief and in the Court's view, is requesting relief beyond this Court's power to
grant. IT IS FURTHER ORDERED 51 Emergency Motion for Permanent
Injunction is also DENIED. Plaintiff failed to adequately address the four-prong test that would satisfy the burden to obtain a permanent injunction.
Although the Court does not find there is adequate basis for implementing a permanent injunction from this jurisdiction, these Findings do not preclude the Plaintiff from pursuing
injunctive relief in Washington, or in any other appropriate place. Neither should this ruling in any way affect the decision or ability of the Washington Court to enter whatever
injunction it feels appropriate.
Finally, the Court denies the request, improperly raised in the reply to the motion, to transfer the ownership of the defendants' trademarks. Plaintiffs' request for
