The Fifth Circuit Court of Appeals issued an opinion on March 13, 2018 allowing Texas Senate Bill 4 (SB4), which bans sanctuary cities, to go into effect while legal challenges proceed against it. This opinion reverses the decision of a lower court which had temporarily blocked the bill. The Court did, however, affirm the lower federal court’s injunction against enforcement of the law as it applies to prohibiting elected officials “endors[ing] a policy under which the entity or department prohibits or materially limits the enforcement of immigration laws.”
